Terms of Service — Perun The Trader

Perun The Trader ("the app") is an automated cryptocurrency trading application for Android, developed and operated by Łukasz Szczepankowski Perun in The Machine (sole proprietor, Polish CEIDG entry; NIP/Tax ID 5213271406, REGON 141477000). By downloading, installing, or using the app, you agree to these Terms of Service. If you do not agree, do not use the app.

1. Description of Service

The app allows you to configure automated trading strategies, grid trading, and position monitoring across supported cryptocurrency exchanges. The app executes trades through each exchange's official public API using API credentials that you provide. All trading decisions are based on configurations and strategies you select; the app is a tool that acts on your behalf and according to your settings.

2. Eligibility

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the app. By using the app you represent that this applies to you and that you are legally permitted to access cryptocurrency trading services in your country of residence.

3. Account and API Credentials

• You are solely responsible for the API credentials you provide. Credentials are stored locally on your device in an encrypted SQLite database and are never transmitted to our servers (see the Privacy Policy).
• You may connect an exchange either by entering credentials manually or, where supported, through a server-assisted OAuth API-key provisioning flow. The only server-dependent feature is this optional OAuth provisioning; all other app features operate without any server.
• You are responsible for the permissions you grant to the app. We recommend granting the minimum permissions required for the features you intend to use.
• You must not share your API credentials or device access with third parties.

4. Acceptable Use

You agree not to use the app to:

• Violate any applicable law, regulation, or exchange terms of service.
• Interfere with, disrupt, or attempt to gain unauthorized access to any exchange system or network.
• Reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent permitted by law.
• Resell, sublicense, or redistribute the app without prior written permission.

5. Financial Risk Disclosure

Cryptocurrency trading involves substantial risk. Prices can be highly volatile, and you can lose some or all of the funds you commit, including via automated strategies, grid trading, leverage, and stop-loss execution failures. Past performance of any strategy is not indicative of future results.

• The app is provided as a technical tool. It is not financial advice, investment advice, or a recommendation to trade any specific asset.
• You trade entirely at your own risk and retain full responsibility for your decisions, configurations, and any resulting gains or losses.
• You are responsible for understanding the risks of the exchanges and instruments you use (spot, futures, margin, leverage) and the tax implications in your jurisdiction.
• We do not guarantee that any order will be executed, executed at the intended price, or that stop-loss, take-profit, or other protective orders will fill at the configured levels.

6. Intellectual Property

The app and the website, including all code, design, graphics, and branding, are the property of Łukasz Szczepankowski Perun in The Machine and remain protected by applicable intellectual-property laws. Your use of the app does not transfer any ownership rights to you. Company and product names, logos, and trademarks of third parties (including exchanges and partners) remain the property of their respective owners.

7. Third-Party Services

The app connects to third-party cryptocurrency exchanges based on your configuration. Each exchange has its own terms of service and privacy policy, which govern your relationship with that exchange. We are not a party to those agreements and are not responsible for the acts, omissions, or failures of any exchange, including outages, API changes, or order execution issues. We recommend reviewing the terms of every exchange you connect to.

8. No Warranty

The app is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, Łukasz Szczepankowski Perun in The Machine shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or funds (including trading losses), whether arising in contract, tort (including negligence), or otherwise, in connection with your use of the app. In no event shall our total liability exceed the amounts you have paid us (if any) for the use of the app in the twelve months preceding the claim.

10. Termination

You may stop using the app at any time by uninstalling it, which removes all associated local data. We may suspend or terminate your access to the app if you violate these Terms, or as required by law. Provisions that by their nature should survive termination — including sections 5 through 9 and 12 — will survive.

11. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be reflected in the "Last updated" date above and notified through app updates and/or the website. Continued use of the app after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Poland, unless mandatory consumer-protection rules in your country provide otherwise.
